1. Acceptance of Terms

By accessing and using the Horizon Bank website (“Site”) and any services provided through it, you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, please do not use this Site. Horizon Bank reserves the right to modify these Terms at any time. Your continued use of the Site after changes constitutes acceptance of the updated Terms.

2. Website Use

This Site is intended for informational purposes and to provide access to Horizon Bank’s products and services. You agree to use this Site only for lawful purposes and in accordance with these Terms. You may not use this Site in any way that could damage, disable, overburden, or impair the Site or interfere with any other party’s use of the Site.

3. Online Banking Services

Access to online banking services is governed by the Online Banking Agreement provided during enrollment. By enrolling in online banking, you agree to the terms and conditions of that agreement, including but not limited to: account access and security requirements, transaction limitations, fee schedules, and service availability. Online banking sessions will automatically time out after a period of inactivity for your security. Multi-factor authentication is required for account access.

4. E-Sign Act Disclosure & Consent

In accordance with the Electronic Signatures in Global and National Commerce Act (E-Sign Act), Horizon Bank may provide certain disclosures, notices, and communications to you electronically. By using our online banking services, you consent to receive electronic disclosures and agree that electronic signatures and records satisfy any requirement for written signatures or paper records. To receive electronic disclosures, you need: a current web browser that supports 256-bit encryption, a valid email address on file with us, and sufficient storage space or a printer to retain copies. You may withdraw your consent to receive electronic disclosures at any time by contacting us at (402) 786-2555 or visiting any branch. Withdrawal of consent may result in the termination of certain online services.

5. Electronic Funds Transfer (EFT) Disclosures

Your rights and responsibilities regarding electronic funds transfers are governed by Regulation E of the Electronic Fund Transfer Act. This includes transfers made through ATMs, point-of-sale terminals, direct deposits, and online or mobile banking.

6. EFT Error Resolution

If you believe an error has occurred with an electronic funds transfer, contact us immediately. You may call us at (402) 786-2555, visit any branch location, or write to us at: Horizon Bank, 13220 Callahan Ave, Waverly, NE 68462. You must notify us within 60 days after the statement showing the error was sent to you. When you notify us, please provide: your name and account number, a description of the error and why you believe it is an error, and the dollar amount involved. We will investigate your complaint within 10 business days (20 business days for new accounts) and will correct any error promptly. If we need more time, we may take up to 45 days (90 days for new accounts, point-of-sale, or foreign-initiated transactions) to investigate, but we will provisionally credit your account within 10 business days for the amount you think is in error. We will notify you of the results within 3 business days after completing our investigation.

7. Bill Pay & Transfer Services

Bill pay and funds transfer services are subject to separate terms and conditions provided during enrollment. Key provisions include: scheduled payments must be submitted with sufficient lead time for processing, you are responsible for providing accurate payee information, Horizon Bank is not liable for delays caused by incorrect information, and transaction limits may apply. Full terms are available within the online banking platform and upon request at any branch.

8. Intellectual Property

All content on this Site, including text, graphics, logos, images, and software, is the property of Horizon Bank or its content suppliers and is protected by United States and international copyright laws. The Horizon Bank name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Horizon Bank. You may not use such marks without the prior written permission of Horizon Bank.

9. Third-Party Links

This Site may contain links to third-party websites for your convenience. Horizon Bank does not endorse, control, or assume responsibility for the content, privacy policies, or practices of any third-party websites. 12. Identity Verification

In compliance with the USA PATRIOT Act and Bank Secrecy Act (BSA/AML) requirements, Horizon Bank is required to verify the identity of any person seeking to open an account or establish a banking relationship. This applies to both in-person and online account opening processes. We may request government-issued identification, Social Security number, date of birth, and other identifying information as part of our Customer Identification Program (CIP).

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Nebraska, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Lancaster County, Nebraska.
